US Supreme Court says Justice Ginsburg appears cancer free after surgery

With the Trump White House doing it all it can to keep the president afloat while buffeted by multiple investigations that could lead to impeachment, aides to the president are also creating battle plans to replace Supreme Court Justice Ruth Bader Ginsburg should she have to step down for health reasons. Doctors who have performed the type of surgery Ginsburg underwent said they are confident that she will recover and return to the High Court by February. On Friday, the court released a written statement saying there is no additional evidence of cancer.

If Ginsburg, who will turn 86 in March, is unable to return to the bench, President Donald Trump would have the chance to nominate a third Supreme Court justice to the highest US court.

"As long as I can do the job full steam, I will do it", she said past year.

Ginsburg, 85, who missed oral arguments this week, has not been on the bench since her surgery last month, but she has participated by reading briefs at home.

But should Ginsburg retire during Trump's presidency, Trump will have the opportunity to fill a liberal justice's spot with another conservative - thus making the ideological balance 6-3.

The Supreme Court's Public Information Office announced on December 21 that Ginsburg "underwent a pulmonary lobectomy" in New York City.

"Roe, I believe, would have been more acceptable as a judicial decision if it had not gone beyond a ruling on the extreme statute before the court", she wrote in the North Carolina Law Review.

A year ago, the news broke that Ginsburg hired law clerks for at least two court terms, signaling she intends to stay through 2020.
